Terms & conditions
All vehicles and equipment are sold under the terms shown on the listing and invoice. Buyers should review all information and request an inspection before purchase.
Seller and contracting party
Your contracting party for all purchases made through this website is Autohaus Arena GmbH, 12529 Schönefeld. Full provider details, including the authorised representative, commercial register entry and VAT ID, are available in the Imprint.
1. Scope
These terms govern website use, enquiries, bids and purchase requests for vehicles, motorhomes and equipment, including commercial vehicles and machinery. A specific transaction is also governed by its listing, the released sales agreement, invoice and any written amendment accepted by both parties. Individual agreements in the sales agreement take precedence over these terms. Conflicting terms of the buyer apply only if the seller expressly agrees to them in writing. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 German Civil Code, BGB). A business is a natural or legal person or a partnership with legal capacity that acts in the exercise of its trade, business or profession when entering into a legal transaction (Section 14 BGB).
2. Listing information
Photographs, descriptions, mileage, operating hours, condition and accessories are presented from the records available. Buyers must review the information and may request additional documents, video or an inspection before making a binding commitment. A listing on the website is not yet a binding contractual offer by the seller; the item may be sold to another buyer until a sales agreement has been concluded.
3. Bids and purchase requests
A Buy Now request is reviewed first and does not by itself complete a purchase. A winning bid may represent a binding purchase intention under the published auction terms. A sales agreement is concluded after verification and acceptance of the released contract. In an auction, every bid must reach at least the displayed minimum amount. The auction ends at the time shown on the listing; there is no automatic extension. No contract is concluded automatically when the auction ends: the seller reviews the bids received and may accept or reject a bid. Bids cannot be withdrawn through the website; if you made an input error, please contact us immediately. Online auctions held by the seller are not auctions within the meaning of Section 156 BGB, so the statutory right of withdrawal for consumers continues to apply.
4. Buyer verification
The buyer must provide complete and accurate identity, contact and, where applicable, company information. The seller may request further evidence or reject a transaction when information is incomplete, inconsistent or cannot be verified.
5. Price, VAT and delivery
The displayed asking price is the final item price including statutory VAT; any displayed discount is already included. Consumers and businesses without a VAT ID pay this final price; VAT is included in it and is not added on top. Businesses that enter a VAT ID in the purchase form pay the price without VAT (net price). Selected delivery charges are shown separately: consumers and businesses without a VAT ID pay the amount shown, businesses with a VAT ID pay the amount without VAT. The amounts in the released sales agreement and invoice are decisive.
6. Contract, invoice and payment
The agreement is released before the invoice and is signed electronically. Bank details are authoritative only when they appear both on the released invoice and on the private transaction page. Transfers must include the exact reference and are complete only after cleared funds are confirmed.
7. Handover, inspection and claims
Collection or delivery follows the option recorded with the order. The buyer must inspect the item at handover and promptly document visible transport damage or discrepancies in writing. Mandatory consumer and defect rights remain unaffected. For consumers, missing documentation does not affect statutory defect rights. For merchants, the duty to inspect and give notice of defects under Section 377 German Commercial Code (HGB) also applies.
8. Withdrawing a request, cancellation and refunds
A non-binding request may be withdrawn before the agreement is signed. After signature or payment, the agreement, these terms and mandatory law apply. The statutory right of withdrawal for consumers remains unaffected; a withdrawal is governed primarily by the withdrawal information below. This must be distinguished from rescission of the contract, which is only possible under statutory rules (for example for defects or payment default) or where contractually agreed. Approved refunds are normally returned to the original payer after required documents and, where applicable, the item have been returned and inspected.
9. Security and liability
Buyers must not transfer funds to an account that is absent from the authorised transaction documents. Indirect loss is subject to the contractual and legally permitted liability limitations. Liability that cannot lawfully be excluded remains unaffected. In particular, the seller is liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulently concealed defects, within the scope of any guarantee given and under the German Product Liability Act. For slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for this type of contract.
10. Applicable law and contact
The law and jurisdiction stated in the individual sales agreement apply, subject to mandatory consumer jurisdiction. For consumers, a choice of law applies only to the extent that it does not deprive the consumer of the protection of mandatory provisions of the country of their habitual residence. Contact our team through the Contact page with questions about these terms.
11. Payment deadline, default and deposit
The purchase price is payable without deduction within 2 days of the invoice date to the account stated on the released invoice, unless a different period is agreed in the sales agreement. The date funds are received is decisive. When the payment period expires, the buyer is in default; statutory rules apply (Sections 286 and 288 BGB). If a reasonable additional period expires without payment, the seller may rescind the contract and/or claim damages in accordance with statutory rules. A deposit is payable only if expressly agreed in the sales agreement. It is credited against the purchase price and refunded in accordance with statutory rules in the event of an effective withdrawal or rescission.
12. Right of withdrawal for consumers
Consumers have a statutory right of withdrawal of 14 days for contracts concluded exclusively by means of distance communication (for example website, email, telephone and electronic signature). This also applies to purchases following an online auction. The start of the period, how to exercise the right and its consequences are set out in the withdrawal information below; a model withdrawal form is attached. If the contract is concluded while both parties are physically present at our business premises, there is no statutory right of withdrawal. Businesses have no statutory right of withdrawal.
13. Retention of title and vehicle documents
The item remains the property of the seller until the purchase price has been paid in full. The registration certificate Part II (Zulassungsbescheinigung Teil II), the EC certificate of conformity (COC) where available, service and maintenance records and all keys are handed over or dispatched only after full and final receipt of payment in the seller's account.
14. Transfer of risk
For collection, the risk of accidental loss and accidental deterioration passes to the buyer at handover. For consumers, the risk also passes only at handover to the buyer when the item is delivered, unless the buyer has commissioned a carrier that was not named by the seller. For businesses, the risk passes when the item is handed to the carrier, unless otherwise agreed. If the buyer is in default of acceptance, in particular by not collecting on time, the risk passes when the default begins.
15. Collection deadline and storage fee
Personal pickup is available exclusively from the seller's company headquarters in Germany. Collection takes place by appointment after contract signing and payment confirmation within the period stated in the listing or sales agreement, or otherwise within 30 days after payment confirmation. Handover at any other location requires a delivery option. If the item is not collected on time, the seller may charge a storage fee in the amount agreed in the sales agreement after the deadline. The buyer may prove that no loss or a significantly lower loss has occurred. Further statutory rights, in particular for default of acceptance, remain unaffected.
16. Liability for defects (warranty)
Statutory defect rights apply with the following provisions: For consumers, defect claims become time-barred two years after delivery. For used items sold to consumers, this period can be shortened to no less than one year only if this has been expressly and separately agreed in the sales agreement before the contract declaration is made (Section 476(2) BGB); these terms alone do not shorten the period. For businesses, used items are sold without liability for defects unless otherwise agreed in the sales agreement; for new items, the limitation period for businesses is one year from delivery. These restrictions do not apply to damage claims for injury to life, body or health, for intent or gross negligence, for fraudulently concealed defects, within the scope of any quality guarantee given, or to claims under the German Product Liability Act. An additional guarantee exists only if it is expressly stated with its conditions in the listing or sales agreement; statutory rights remain unaffected.
17. Purchases from abroad
Buyers from abroad are welcome. Customs duties, import charges, export or transfer plates and registration costs in the country of destination are borne by the buyer unless otherwise agreed.
18. Margin scheme listings
For listings identified as sold under the margin scheme, the price shown is the final price for all buyers; VAT is not shown separately and no net price is displayed.
19. Force majeure
Events of force majeure that temporarily prevent the seller from performing or make performance significantly more difficult, such as natural events, epidemics, strikes, official measures or comparable circumstances for which the seller is not responsible, extend delivery and collection deadlines by the duration of the impediment plus a reasonable start-up period. If the impediment lasts longer than two months, either party may rescind the affected contract; payments already made are refunded without delay. Mandatory statutory rights remain unaffected.
20. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).
21. Contract text and language versions
The sales agreement and invoice are stored by the seller and, once released, provided to the buyer as PDF documents on the private transaction page for viewing and saving. Input errors can be corrected before a form is submitted by amending the entries; after submission, details can be corrected through our team until the agreement is released. Contracts can be concluded in German or English. These terms are available in German and English; in the event of any discrepancy between the language versions, the German version prevails.
22. Severability
Should individual provisions of these terms be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected. Invalid provisions are replaced by the statutory provisions.
Information on the right of withdrawal
The following information applies only to consumers (Section 13 BGB).
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us (Autohaus Arena GmbH, 12529 Schönefeld) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
